The Court of Justice of Santa Catarina, when judging a conflict of jurisdiction, understood that the power to judge pet pensions lies with the Family Courts and not the Civil Court.
The specific case referred to an action in which the woman sought to enforce an agreement signed by the former couple in which the man agreed to pay a monthly allowance to contribute to the expenses of the pets they had during the period of their stable union.
The decision only strengthens the institution of multispecies families, which are those formed by people from a family nucleus who develop an emotional bond with pets.
The recognition of these families and the rights of pets has been increasingly validated. So much so that the Superior Court of Justice (STJ) has already recognized the possibility of defining visitation rights for pets after the end of a relationship, and there is even a bill (PL 179/23) to regulate this type of family.
