In a decision by the 1st Panel of the Regional Labor Court of the 2nd Region (TRF 2), the legal personality of a company was disregarded and, given the impossibility of fulfilling the obligation by the main debtor, a partner of the company was held liable for the debt of the legal entity, prior to her entry into the company.

According to the case reporter, when a partner joins a company, even though the debt predates his entry, he is liable for all his liabilities equally with the other partners who were already in the company.
