The 8th Civil Chamber of the Court of Justice of Minas Gerais overturned a ruling to grant a self-employed professional the right to annul her marriage to a fraudster.

In the case analyzed, the man presented himself as the son of a businessman and paid for expensive dinners and luxury cars, claiming that he was taking care of his father’s business to impress his wife.

After the wedding, the husband’s behavior changed drastically, leaving him living off his wife’s family and not contributing financially. Furthermore, he refused to help with household expenses, claiming he had money in the bank but needed a court order to access it.

As if that weren’t enough, the husband harmed his wife’s family through fraudulent transactions. When creditors began to question him, the husband disappeared, deleting his social media accounts and blocking his wife and her family on WhatsApp.

After threats from her husband, the victim filed a police report and filed a petition to annul the marriage in March 2019.

In analyzing the case, the rapporteur highlighted that the man had already been arrested for carrying out the same scam and concluded that there had been a fundamental error in relation to the person, making it possible to annul the marriage.
