The Court of Justice of São Paulo ordered an increase in alimony so that the daughter has the same standard of living as her father in an appeal trial.
The appeal was filed by the author, in view of the judgment that partially upheld her requests in the first instance, setting the alimony at 1.5 minimum wages.
Unsatisfied, the author filed an appeal, claiming in summary that the alimony should be set at 3 minimum wages, as she proved that the father had the capacity to pay amounts higher than those set in the first instance and that the mother receives a low salary and is unable to cover the basic expenses of the alimony recipient.
In the appeal trial, it was understood that alimony must be set at a real level, so that it reflects the needs of the person receiving alimony and the possibilities of the person providing it, with the setting being governed by the possibility x need binomial.
Therefore, the appeal was partially granted, to increase the amount of alimony to 2 minimum wages.
