On November 25, 2022, Decree No. 11,266 was published, which aims to reinforce the protection of the privacy of citizens’ personal data before the Federal Public Administration.
Among the changes listed in the aforementioned Decree, we can highlight the preservation of the intimacy and privacy of the natural person in cases involving data processing, and the limitation of the sharing of personal data to the minimum necessary to fulfill the intended purpose, giving due publicity in case of sharing or access to personal databases.
The decree also prohibits the use of the Citizen Base Registry or its cross-referencing with other databases for the purpose of mapping or exploring citizens’ behavior without their express, prior and specific consent.
It is noted that data protection is becoming increasingly stronger and that the topic is gaining importance in both the private and public sectors, representing an important advance and victory for citizens.
