According to Law 14,151, of May 13, 2020, teleworking was guaranteed to pregnant women, while the public health emergency resulting from the COVID-19 pandemic continues, without prejudice to the worker’s remuneration.

The Law also provides that pregnant women must be available for remote work whenever possible.

However, the legislation did not provide further information about the areas that could carry out this type of treatment for pregnant women, nor even the conditions for said leave.

As a result, Bill No. 2058/21 is currently being processed in the Chamber of Deputies, which allows pregnant women to return to in-person work after vaccination. However, due to changes to the bill’s text made in the Senate in December 2021, the bill was returned to the Chamber for further approval.

Therefore, there is still no legislative determination for the return of pregnant women to in-person work.
