The Supreme Federal Court’s plenary session is currently considering a trial to determine whether companies can fire unvaccinated employees for just cause.
It all started with the publication of Ordinance 620/2021 by the Ministry of Labor, which prohibited companies from requiring proof of vaccination against COVID-19 from their employees, under the argument that it was a discriminatory act by employers.
The matter was taken to the STF Plenary, which has not yet finalized its judgment on the matter, but there is already a vote from the rapporteur, Min. Roberto Barroso, to the effect that only employees who present medical proof of impossibility of vaccination should be exempt from immunization.
The current score of the trial is 4-0 and the trial may be resumed and finalized at any time.
