In Brazil, there is still no regulation regarding the hybrid work regime, which emerged more strongly with the COVID-19 pandemic.
For this reason, Bill (PL) No. 10/2022, which is being processed in the Federal Senate, proposes changes to the Consolidation of Labor Laws (CLT) in order to regulate the hybrid work regime.
Through the PL, it is proposed that the hybrid work model be included in the employee’s individual employment contract and there is a guarantee of the possibility of modifying the work regime, through a contractual addendum to ratify the agreement between the employer and employee parties, with a minimum period of 30 days for the transition between regimes, whether teleworking, hybrid or in-person.
Another point provided for in the Bill is the possibility of stipulating specific dates for teleworking in the employment contract and, if the employee needs to be physically present, the employer must request their presence 24 hours in advance.
