The Federal Public Prosecutor’s Office, guided by the New York Convention, which provides for measures to facilitate the provision of alimony abroad, filed a lawsuit against Banco do Brasil seeking to have the bank abstain from charging fees and charges on the transfer of alimony amounts abroad.

The discussion reached the Superior Court of Justice (STJ), which ruled that the exemption provided for in the New York Convention should also apply to bank fees required for the payment of foreign pensions.

According to the STJ’s understanding, the exemptions and facilities provided for in the Convention would not be limited to legal expenses and should “include all procedures necessary for the implementation of the judicial decision, including the banking service for sending funds abroad.”

The STJ highlighted that the objective of the exemption is to facilitate the obtaining of food, which is why the request was supported by the rules of the Federal Public Ministry based on the Convention.
