Are occupational health examinations still mandatory during the pandemic?

Given the Decree that re-established the red phase in São Paulo, the question arises about the possibility of postponing occupational exams.

At the beginning of the pandemic in 2020, Provisional Measure 927 was enacted, allowing the suspension of these exams, with the exception of the exit exam. However, the Provisional Measure lost its validity, reinstating all labor regulations and, with it, the requirement for occupational exams.

It’s worth noting that the Ministry of Economy has already publicly announced that it is working on a proposal similar to last year’s. We remain awaiting further updates, as it is urgent that the Ministry of Labor address these issues as soon as possible.
