In a decision handed down in the first instance of the Labor Court of São Paulo, the approval of an agreement for an amount lower than that of the Labor Execution was denied, because the amount due had already been

guaranteed by means of attachment of bank accounts held by the debtor, carried out through SISBAJUD.

The agreement was added to the records only after the debtor’s financial assets were frozen and the judge understood that the approval of the agreement is up to the Court, which may refuse it.

Furthermore, after the judicial blockade, the debtor became aware and did not respond within 5 days, as expected, at which time the judge considered his response regarding the attempted agreement to be barred, with the consequent termination of the execution and determination of the release of the deposit to the worker.
