The first thing that comes to mind when talking about non-payment of alimony is filing a civil action to enforce the alimony, and the person paying alimony may be imprisoned in case of non-payment for up to 60 days, according to the Alimony Law.

However, non-payment of alimony can also have repercussions in the criminal sphere.

This was the ruling of the 1st Criminal Division of the Court of Justice of the Federal District and Territories (TJDFT) when it convicted a father who failed to pay child support to his minor daughter for eight years. The man was convicted of the crime of material abandonment, as defined in Article 244 of the Penal Code, and sentenced to one year’s imprisonment and a fine.
