The legal recognition of socio-affective maternity and paternity is already widely recognized in the legal field and even in society as a whole, and in some cases it is possible to pursue this recognition extrajudicially directly at the registry office.

However, in a case submitted to the judge of the 1st Family Court of Juiz de Fora, Minas Gerais, the claim for emotional ties concerned the grandmother. The minor’s biological grandfather remarried, and his new partner developed a strong emotional bond with his partner’s granddaughter, a situation recognized by the other family members, ultimately allowing for the recognition of socio-affective grandparenthood.

The decision is a victory for family law and merely confirms that justice is in harmony with social evolution. The term “family” takes on an increasingly broader meaning, and affection is elevated. After all, family is who truly welcomes you, shows you love, respects you, cares for you, and deserves recognition and protection from the State.
