The Regional Labor Court of the 15th Region (Campinas-SP) confirmed the understanding of the first instance judge recognizing, exceptionally, the possibility of equalizing the father to enjoy the same period of maternity leave.

In this case, the man had premature twins during the pandemic and took 20 days of paternity leave. Given the special needs of his children and the risks posed by the state of public calamity, he took legal action, based on the principle of equality, seeking an extension of his leave.

The 1st Instance decision ordered the company to compensate the employee for the period of 120 days of leave, which was reformed by the TRT-15 to limit the compensation to 100 days, discounting the 20 days of leave taken.
