In its 95th virtual session, the Plenary of the National Council of Justice recommended that in tax cases judges use conciliation, mediation or negotiation to resolve disputes. In addition, the guidance also provided for the use of arbitration in this type of demand.
The implementation aims to reduce the number of tax lawsuits and increase revenues for Municipal, State and Federal Tax Authorities, in addition to helping companies settle their tax debts, avoiding repetitive lawsuits in the Judiciary.
The guidance is that the courts begin to implement Judicial Centers for the Resolution of Tax Disputes, which will be guided to resolve cases with repeated themes in the Judiciary, so that, in a consensual manner, the taxpayer can resolve their tax demands.
