In the judgment of Special Appeal No. 1,914,596, the Superior Court of Justice decided that internet connection providers must provide personal data (name, address, ID and CPF) of users who publish on the internet.
The case concerned the publication of videos on YouTube that insulted the memory of a deceased person.
According to the ruling, application providers must store connection data, such as IP addresses, and connection providers must store the personal data of Internet users.
Therefore, in cases of unlawful user conduct, the user’s privacy should not prevail, the STJ decided, which does not conflict with the rules established by the General Data Protection Law, since personal data can serve as an element for the exercise of rights in judicial, administrative and arbitration proceedings.
