Provisional Measure No. 1,124 was issued, the main objective of which is to transform the National Data Protection Authority (ANPD) into a special federal agency.

Now, the ANPD is on par with other entities of a similar nature, such as regulatory agencies (ANVISA, ANATEL, etc.) and the Central Bank of Brazil, endowed with legal personality under internal public law, giving it, including, procedural capacity to activate the Judiciary in the defense of collective rights in a broad and diffuse sense, being able to file public civil actions, in addition to the possibility of promoting the execution of compliance with administrative sanctions decreed by the entity after the end of the administrative sanctioning process against public entities and private organizations.

In fact, it should be taken into account that, now, the new authority has full legal and administrative conditions to establish, in the future, regional units throughout Brazil, simply needing to have financial and budgetary conditions, bringing the ANPD closer to all territorial spaces, which could lead to quite significant regulatory and even administrative or judicial contentious action.
