The Federal Supreme Court (STF) decided that compensation for moral damages arising from labor lawsuits may exceed the limit established in the Consolidation of Labor Laws (CLT), which classifies offenses against the CLT considering their severity: (i) minor damage (up to three times the last salary);
(ii) medium damage (up to five times); (iii) serious damage (up to 20 times); and (iv) very serious damage (up to 50 times).
However, in the decision handed down by the STF, it was understood that the criteria presented by the CLT are merely indicative and do not constitute a ceiling imposed by law.
