The Mato Grosso Court of Justice granted sole custody of a two-year-old child to the mother, after recognizing domestic violence committed by the child’s father. The decision overturned a previous injunction that had determined joint custody.

The court records state that the woman suffered physical and psychological abuse during the relationship, including during pregnancy. Emergency protective measures were granted in her favor, and she remains under specialized psychosocial care.

Based on Law 14,713/2023, which strengthens the protection of children and adolescents exposed to domestic violence, the panel understood that living with the abusive parent could compromise the integrity of the daughter and mother.

The reporting judge emphasized that the documentary evidence attached to the case was sufficient to demonstrate the real risk involved and justified the need to rule out shared custody, prioritizing the best interests of the child.
