A man was ordered by a São Paulo court to pay moral damages to his ex-wife for having baptized his 4-year-old son without informing the child’s mother.
The child’s mother discovered that her son had been baptized more than a year after the ceremony through photos that were posted on the social media of her son’s father’s current wife and that her son’s godfather was a man who testified against her and in favor of the father in a domestic violence case.
According to the judge, the father’s conduct is eligible for compensation, given that the parents had shared custody of the child, and were responsible for deciding on religious issues, among others, related to the child. The father’s attitude prevented the mother from participating in an important moment in the child’s life.
He also highlighted that the “defendant’s conduct is not morally acceptable, because even if he has disagreements with his ex-wife, he has a duty to have a good relationship with her regarding matters related to the son they have in common”, ultimately sentencing the father to pay compensation in the amount of five thousand reais.
